Tesla accused of consumer fraud by a Beijing company

Shanghai (ZXZC)- A Beijing company took Tesla to the court, saying the electric carmaker should be responsible for its failure to get a free license plate for its new bought Model X 100D, Techweb reported.

The plaintiff claimed that through taking the advantage of the customer’s trust and deliberately hiding the truth, Tesla misled the consumer to make a big purchase and thus constituted consumer fraud. According to Techweb, the Beijing company requested RMB 4 million for compensation. Beijing Daxing District Court has agreed to deal with this case.

On February 26th , the company bought a Model X 100D, but was not explicitly told that the model hasn’t been included in the recommended new energy model lists. That means the consumer cannot have a new energy license plate. It is not until May 5th when the consumer tried to register the car that the consumer realized the model hasn’t been included in the list and the new bought car cannot have a formal license plate. Afterwards, the consumer has repeatedly made inquiry about the license and the automaker said the model will be on the list in May. However, even now the model hasn’t managed to get into the list.

The plaintiff said that it had made an all-around preparation for the new car, such as charging pile and new parking space. But now, the car had to be put in the garage without any use and the monthly parking cost is 400 yuan (61.3 dollars). Consequently, the consumer demanded three times of the car’s original price plus other expenses.

As to the lawsuit, Tesla said that according to the purchase agreement, the buyer itself should be responsible for the registration issue. Tesla managed to deliver the car and thus met the terms of the agreement. The carmaker pointed out that it is Tesla that will decide whether to offer help for cars’ registration.
